The K.I.S.S Marketing Agency Pty Ltd (ABN 81 606 432 544) (“K.I.S.S”, “we”, “us”, “our”) owns and operates www.thekissagency.com. These terms apply when you use our website or book our meeting room. By using the website, you agree to them.
1. Using our website
1.1 We aim to keep the information on this website accurate and current, but we don’t guarantee it is complete or error-free. We may change or remove content at any time without notice.
1.2 We don’t guarantee the website will always be available or free from viruses or errors.
1.3 You must not misuse the website, including by trying to gain unauthorised access, interfering with how it works, or collecting data from it by automated means.
2. Intellectual property
2.1 We own or license the content on this website, including text, images, graphics, logos and code. It is protected by the Copyright Act 1968 (Cth) and other laws.
2.2 You may view, download and print pages for your own personal, non-commercial use. You must not reproduce, adapt, publish or distribute our content without our written permission.

4. Marketing services
Our marketing services are provided under the terms supplied with your quote or engagement letter. Those terms apply to your engagement and take priority over these website terms if there’s any inconsistency.
5. Meeting room hire
These terms apply to bookings of our meeting room at Suite 9/17 Gerrale Street, Cronulla NSW 2230.
5.1 Payment. Full payment is required to secure your booking. We’ll send you an invoice, which you can pay by bank transfer or by credit card through the link on the invoice. Payment is due within 7 days of the invoice date, and before your booking starts. A booking is confirmed only once we’ve received payment in full.
5.2 No holds. We don’t hold or reserve dates before payment is received. Until then, the room may be booked by someone else.
5.3 Cancellations. Cancellations must be made in writing to hello@thekissagency.com. The time we receive your email is the time of cancellation.
5.4 Refunds. If you cancel more than 48 hours before your booking start time, we’ll refund your payment in full. No refund is given for cancellations made within 48 hours of your booking start time.
5.5 Changes to your booking. You can move your booking to another date by contacting us in writing at least 48 hours before your booking start time. Changes are subject to availability.
5.6 If we need to cancel. If we have to cancel your booking for any reason, we’ll let you know as soon as possible and refund your payment in full.
5.7 Using the space. Bookings are for up to 8 people. You’re responsible for your group while on the premises, for leaving the room clean and tidy, and for the cost of repairing any damage your group causes. Smoking isn’t permitted. Alcohol is allowed in moderation.
5.8 Booking times. The room is available 7 days a week, 9am to 5pm. Your booking includes access for the hours booked only. Full-day bookings are up to 8 hours.
6. Liability
6.1 Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that can’t be excluded.
6.2 Subject to clause 6.1, we aren’t liable for any indirect or consequential loss arising from your use of the website or the meeting room. Where our liability can be limited, it is limited to re-supplying the service or refunding the amount you paid for it.
7. Privacy
Our Privacy Policy explains how we collect and handle personal information.
8. Changes to these terms
We may update these terms from time to time. The version on this page at the time you use the website or make a booking applies.
9. Governing law
These terms are governed by the laws of New South Wales, Australia. You agree to the jurisdiction of the courts of New South Wales.
